We appreciate your business at Art of Hi™.

This site ("Site") is operated by The Easy Life LLC as the brand Art of Hi™ ("Art of HI"). Please read these terms of use, ("Terms") and our Privacy Policy. By accessing this site or using the services offered on the Site, including by responding to a registered user’s request to provide your contact information, you indicate your agreement to these Terms. If you do not agree, please do not use this Site. We may modify these Terms (including the Privacy Policy) from time to time by displaying updated Terms on the Site. Your continued use of the Site after updated Terms are displayed indicates your agreement to the modified Terms.

We pride ourselves on accurately processing, printing, and mailing your cards on the next business day.

You understand and agree that the term Art of Hi™ is our trademark and valuable intellectual property. In using the system, you also agree that you understand copyright law; namely, that you cannot use a photograph that you did not personally take or have a written license to use. Moreover, you cannot use a photograph that has a person in it that you do not have a model release form. You agree that you will protect, indemnify, and hold us harmless in any cease and desist or law action related to your cards. Please be sure you understand what you can and cannot do under the law!

You understand that your Credits are good for twelve (12) months from the date you receive them; after which they expire.

A User is an Art of Hi website public user or registered user who has interacted with Art of Hi’s website services. Art of Hi does not use or access any contact data stored in the user’s Address Book except for application and system administration research and development or specifically requested to do so by the User. Art of Hi does not contact, use, or sell contact information stored in the Address Book with or for third party advertisements of any kind. We invite you to reach out if you have questions about this policy at artofhi@goweb1.com.

Refund Policy / NOTICE OF RIGHT TO CANCEL

You may CANCEL the purchase of unused credits, without any penalty or obligation, within THREE BUSINESS DAYS from the date of purchase, (Five days for Alaska residents or as required by law). If you cancel within three business days, your payment will be returned within TWENTY BUSINESS DAYS following receipt by us of your cancellation notice. If you cancel, any cards that you have in the queue and not already processed will be immediately canceled. The refund will be prorated if any credits have already been used from the purchase.

To cancel this transaction, email a signed and dated copy of this Cancellation Notice or any other written notice, to artofhi@goweb1.com no later than three (3) business days following the initial sign-up date for Art of Hi.

Terms and Conditions

  1. Art of Hi DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Art of Hi SHALL NOT BE RESPONSIBLE FOR DAMAGES, INCLUDING BUT NOT LIMITED TO SPECIAL, ECONOMIC, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY, ARISING FROM OR RELATING TO LOSS OF ANY CUSTOMER'S DATA OR ANY OTHER COMPUTER SYSTEM FAILURE OR PROBLEM.
  2. Credit expiration will take place at the end of the twelfth month from the date the credits were posted to your account.
  3. Art of Hi is not responsible for delivery delays, damage to, or loss of cards by the postal service or other mail or delivery companies in the U.S. or any country.
  4. Art of Hi is not responsible for deliverability and inaccuracies of cards, ecards, or general communications by both internal and external systems including but not limited to software errors, server errors, email systems, mobile applications, and third party solution partners.
  5. Art of Hi is not responsible for cards, ecards or gifts sent to the wrong recipient by the sender.
  6. All sales are FINAL. The initial sale is subject to the buyer's right to cancel as set forth in the Refund Policy/NOTICE OF RIGHT TO CANCEL as outlined above.
  7. By using Art of Hi, your action signifies your agreement to these terms and conditions (the "Terms of Use"), and Art of Hi’ privacy notice. If you do not agree, please do not use the services. Art of Hi may, in its sole discretion, modify or revise these Terms of Use and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in these Terms of Use shall be deemed to confer any third-party rights or benefits.
  8. Application. These Terms of Use apply to all users, including users who are also contributors of Content on the Services. "Content" includes the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through, or contribute to Art of Hi. It includes all aspects of Art of Hi.com. Art of Hi.com may contain links to, or otherwise indicate methods to access third party websites or content providers that are not owned or controlled by Art of Hi. Art of Hi has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or content providers. In addition, Art of Hi will not and cannot censor or edit the content of any third party. By using Art of Hi.com, you expressly relieve Art of Hi from any and all liability arising from your use of any third party website or content provider.
  9. Accounts. In order to access some features, you will have to create an account with Art of Hi. You may never use another’s account without express written permission to do so. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Art of Hi immediately of any breach of security or unauthorized use of your account. Although Art of Hi will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Art of Hi or others due to such unauthorized use.
  10. Your Use of Content. The following restrictions and conditions apply specifically to your use of Content. Content is provided to you "AS-IS". You may access Content for your information and personal use solely as intended through the provided functionality of Art of Hi and as permitted under these Terms of Use. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Art of Hi or the respective licensors of the Content. Art of Hi and its licensors reserve all rights not expressly granted in and to the Content.

  11. Your use of Address Book features. To create an online address book ("Address Book"), you must register by creating a user account ("Account") with a username and password and providing other information as part of the registration process. When you register and create an Account, you can add contact information to your Address Book. You may also send emails inviting others to be added to your Address Book by providing you with their contact and other information. If the person you invite wishes to be included in your Address Book, he or she may visit our Site to complete an online form, which includes both mandatory information (such as name and address) and optional information (such as cell phone, home phone, preferred email, birth month and day, and name of spouse, if applicable). A person does not have to register and create an account to be included in your Address Book. If you register for an Account and create an Address Book, you agree to update or delete any entries in your Address Book as requested by the person(s) who provided the information or by the person(s) about whom the information applies (e.g., a spouse). If a person notifies our Site that he or she wishes to have his or her contact information deleted from your Address Book, we will notify you about the request; we reserve the right to delete the person’s contact information from your Address Book.

    Art of Hi provides businesses and organizations with a variety of tools to collect names, mailing addresses, phone numbers, email addresses, and other information on an opt-in basis. Art of Hi also provides a tool to help you import contact data. However, contact information may be imported only if the contact gave full consent to receive a specified type of messaging from you.

  12. Your Content and Conduct. As an Art of Hi account holder you may submit or utilize your own Content. You understand that Art of Hi does not guarantee any confidentiality with respect to any Content you submit. You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content that you submit; and you license to Art of Hi all proprietary rights in and to such Content for publication pursuant to these Terms of Use. For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to Art of Hi, you hereby grant Art of Hi a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, and display the Content. You also hereby grant each user a non-exclusive license to access any Content you deem "public," and to use, reproduce, distribute, display and perform such Content as permitted under these Terms of Use. The above licenses granted by you are perpetual and irrevocable. You further agree your Content will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant Art of Hi all of the license rights granted herein. Art of Hi does not endorse any Content submitted, or any opinion, recommendation, or advice expressed therein, and Art of Hi expressly disclaims any and all liability in connection with Content. Art of Hi does not permit copyright infringing activities and infringement of intellectual property rights associated with Art of Hi.

    You expressly agree that you will not use the Art of Hi application:

    • for any unlawful purpose, including posting, storing, sending, or otherwise transmitting information, data or material that is libelous, obscene, threatening, harassing or defamatory or which infringes the intellectual property rights of any person or which in any way encourages conduct that would be unlawful or inappropriate;
    • in connection with any unsolicited bulk or commercial messages (commonly known as "spam"), any advertising or other form of communication that violates these Terms or any law or regulation, or in any manner that would disrupt in any way any internet site or services;
    • to initiate or perpetuate any illegal scheme (such as a pyramid scheme);
    • to harvest (or engage in any type of systematic retrieval of) e-mail addresses or other identifiers or information or collect e-mail addresses;
    • to impersonate any person or entity, falsify any sender address, forge anyone’s identity or perform any other fraudulent activity (such as "phishing");
    • to interfere with, or attempt to interfere with, any person’s ability to use the services offered on the Site;
    • to transmit or otherwise make available through our Site any computer code, file, program or other element (including any virus, worm, or other harmful malware of any nature) that would interrupt, destroy, interfere with or otherwise cause any other effect that might reasonably be considered undesirable;
    • to register or attempt to use the services under the name of another person, allow another person to use your username or password or your Account, use another person’s Account; or
    • to attempt to (or actually) circumvent the Site’s security or any means to control access to the Site’s services.

  13. Ownership. Unless otherwise noted, all rights, title and interest in all information including, but not limited to, screens, texts, user names, passwords, web pages, or other materials (collectively “Information”) appearing in and on this Site are the exclusive property of Art of Hi. Art of Hi’s use of such information is subject to its Privacy Policy.

    You acknowledge that all content on or provided through this Site, including, but not limited to software, images, illustrations, whether tangible or intangible (collectively “Content”), is protected by copyrights, trademarks or service marks and other intellectual property rights which are owned and controlled by Art of Hi or by third parties that have licensed their Content or the right to market and sell their products to Art of Hi. Such Content may not be copied, reproduced, republished, uploaded, posted, transmitted, distributed or exploited in any way, without proper permission from the Content’s owner.

    "Art of Hi" and other names, trademarks, service marks, and indicia of source ("Art of Hi Trademarks") are owned by Art of Hi. You may not use the Art of Hi Trademarks in connection with any products or services that do not belong to Art of Hi or in any manner likely to cause confusion about the source of any product or service, that implies that Art of Hi endorses anyone else’s product or service, or that disparages or discredits Art of Hi.

  14. Warranty Disclaimer. YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, Art of Hi, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. Art of Hi MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE’S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES. Art of Hi DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND Art of Hi WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD- PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE
  15. Limitation of Liability. IN NO EVENT SHALL Art of Hi, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT Art of Hi SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. The Services are controlled and offered by Art of Hi from its facilities in the United States of America. Art of Hi makes no representations that they are appropriate or available for use in other locations. Those who access or use the Services from other jurisdictions do so at their own volition and are responsible for compliance with local law.
  16. Indemnity. To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Art of Hi, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to Art of Hi.com; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the Services.
  17. Ability to Accept Terms of Use. You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.
  18. Assignment. These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Art of Hi without restriction.
  19. General. You agree that: (i) the Services shall be deemed solely based in Illinois; and (ii) the Services shall be deemed a passive website that does not give rise to personal jurisdiction over Art of Hi, either specific or general, in jurisdictions other than Illinois. These Terms of Use shall be governed by the internal substantive laws of the State of Illinois, without respect to its conflict of laws principles. Any claim or dispute between you and Art of Hi that arises in whole or in part from the Services shall be decided exclusively by a court of competent jurisdiction located in Sangamon County Illinois. These Terms of Use, together with any other legal notices published by Art of Hi, shall constitute the entire agreement between you and Art of Hi concerning the Services. If any provision of these Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and Art of Hi’s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision. Art of Hi reserves the right to amend these Terms of Use at any time and without notice, and it is your responsibility to review these Terms of Use for any changes. Your use of the Services following any amendment of these Terms of Use will signify your assent to and acceptance of its revised terms.
